Who Is At Fault for Your Accident? 

In order to secure compensation for injuries and other damages sustained in an automobile collision in the Greater Boston Area, you must show that you are no more than 50 percent at fault for the crash. Massachusetts follows what is known as the “modified comparative negligence,” or shared fault, rule. Under this rule, you may still be able to collect compensation if you were partially at fault for an accident, as long as the other driver was as much or more at fault. 

There are plenty of reasons someone could be considered “at fault” for an accident. In general, most of them come down to the idea of “negligence,” or willful disregard of the duty of care that someone has to those around them. This could be a willful choice, such as deciding to send a text message while driving, but it could also be purely accidental, such as in the case of a defective vehicle or poor road maintenance causing the incident in question.
