What Is a Catastrophic Injury?
Massachusetts law defines a “catastrophic injury” as an injury that results in permanent impairment for the victim.
These can include, but are not limited to:
- Spinal cord injuries involving paralysis
- Severe burn injuries covering 25 percent or more of the body or 5 percent or more of the face and hands
- Amputation of an arm, hand, foot, or leg
- Severe communication, sensory, or motor disturbances
- Severe brain injuries
Massachusetts law does acknowledge that this law is incapable of covering unique incidents, so it also includes a clause that reads “any other injury that would otherwise qualify pursuant to this chapter,” to leave room to apply this label to a unique situation.
Common Causes of Catastrophic Injuries
Catastrophic injuries can arise from a myriad of circumstances, including:
Please note that the above list is not exhaustive. If you have sustained a catastrophic injury due to another party's negligence under circumstances that we did not mention in the list above, we encourage you to schedule a free consultation with one of our attorneys.
