Who Can Bring a Wrongful Death Claim in Massachusetts?

Under Massachusetts General Laws Chapter 229, Section 2, a wrongful death lawsuit must be filed by the executor or administrator of the deceased person’s estate. While the personal representative may formally bring the claim, the beneficiaries (typically the surviving spouse, children, or other dependents) are the ones who receive compensation.

The law allows families to pursue claims for deaths caused by negligence, breach of warranty, or willful/wanton misconduct. Understanding who qualifies and how to proceed can be complicated, but our attorneys are here to help. Our team takes pride in helping clients navigate complex legal processes and understand intricate requirements with confidence.
